There is an abundance of inaccurate informationabout Small Claims Courts and how one can file and pursue acomplaint within. In addition, most people are simply unaware ofhow the process works. The Small Claims Court process is not the onlyway, but has been the most effective way for me to collect recourseagainst companies that have mistreated me. You too can do this onyour own for a small court filing fee. In fact, you can request thejudge to order the company to reimburse your court fees in theevent of a favorable judgment.

Companies hate going to Small Claims Courts.Their in house legal counsels have better things to spend theirtime on than petty cases (at least from their perspective). There is plenty of confusinginformation online as to where you should file your claim, andfiling in the right jurisdiction is very important or your casewill be dismissed with no reimbursement of filing fees.

The main lesson that I want you to take awayafter reading this book however is that most people just walk awayfrom their grunts and grudges and choose not to deal with companiesthat mistreat them or cause them damages mainly because of theunknowns involved. Whatever your situation is, in order to getresults, you MUST TAKE ACTION! It all starts by educatingyourself about the law, recourses available to you and the processof how exactly to get it.

Note:This process appliesto disputes against individuals and companies. For simplicity, thelanguage in this book will primarily refer to companies. However,keep in mind that the same principles apply when attempting toresolve disputes with individuals as well.

What If You DontWin in Small Claims Court?

That is not possible. Why? Because two thingscan happen, you are either awarded compensation for your troublesor the Judge decides to dismiss the case.

If the case is dismissed, the company you aresuing would still have gone through the case preparation process.This often involves engaging their in house legal counsel or anoutside attorney who spends time preparing for the case. Attorneysare not the most economical professionals.

You may not get compensated, but either way youlook at it, you will definitely get your message across to thecompany. What typically happens is that companies will contact youand attempt to settle the case to prevent it from entering into thelitigation phase. For most companies, this beats paying thousandsof dollars for an attorney.

With that said, you dont have to agree to asettlement.
