Preface
This book began as an analysis of the constitutional jurisprudence of Robert H. Jackson, a justice who, unfortunately, has not received his due in the literature of public law. I soon realized, however, that Jackson is best understood when compared with his more celebrated brethren, Hugo L. Black and Felix Frankfurter. Together, the justices revealed the remarkable jurisprudential diversity of Franklin Roosevelt's New Deal coalition. More generally, they illuminated jurisprudential implications of varying political and intellectual responses to one of the most significant events of the late nineteenth and early twentieth centuries: the urban-industrial transformation.
