Dear Reader,
The first time I encountered the U.S. Constitution, half a century ago, just a week of our mandatory high school American History course was devoted to how a bill becomes a law, the three branches of government, and the Bill of Rights. Over the next ten years, studying the Constitution first as an undergraduate and later as a law student, my classmates and I never considered that anyone discussing the Constitution might have an agenda. The Constitution was the Constitution, or so we thought.
Today, as elections have become increasingly polarized, so have interpretations of what the Constitution was or was not intended to mean. People wave it as a banner, convinced their interpretations are the only interpretations.
In writing this book, I have tried to stick with the attitude of that earlier time when I first read the Constitution to rely on the law as it stands, without trying to say whether laws are good or badthey simply are. The genius of the document that has governed the United States for two and a quarter centuries is that it has managed to evolve with the American people and reflect who they have become. The laws written to complement it may change, but even as new laws are written, or old ones are interpreted differently, the Constitutions basic functions and principles remain the same. The purpose of this book is to help you understand how it works, why it works that way, and how it has changed over the years.
