The Constitution Under Social Justice: summary, description and annotation

Antonio Rosmini-Serbati (1797D1855) was one of the first natural law scholars to bring natural law thinking into a conversation with the market economic order that was beginning to emerge in Europe in the 19th century. His reflections on matters such as the origin, nature, and limits of private property, the role of the state, and the nature of human reason show him to be a unique, innovative thinker who nonetheless was determined to work within the parameters of Catholic doctrine. Many of these ideas are concretized in his seminal work The Constitution Under Social Justice, a text that has profound instights to offer those today seeking to integrate theology, philosophy, and economics into their conceptions of a social order that aspires to be both free and just.

NOTES

From 1789 to the present, France has changed or modified the form of its government at least eleven times. The following list indicates the series of constitutions and the duration of each:

YearsDays
I.Constitution of September 3, 1791, which lasted until August 10, 1792, that is, not even one year0341
II.Constitution of June 24, 1793. This constitution was never implemented00
III.Constitution of August 22,1795, which lasted until November 10, 1799 (18th Brumaire)480
IV.Constitution of December 13, 1799, which did not endure in its integrity until the senate consulting committee of August 4, 18023235
V.Senate consulting committee of August 4, 1802, up to May 18, 18041288
VI.Senate consulting committee of May 18, 1804, which was kept until the decree of the senate of April 3, 1814, through which the Emperor Napoleon was deposed9321
VII.Constitution decreed by the senate on April 6, 1814, which was never implemented00
VIII.Constitutional charter of June 4, 1814, which lasted until March 1, 18150302
IX.Additional act to the Constitutions of the Empire of April 22, 1815, up to June 22, 1815061
X.Restitution of the charter of June 4, 1814, which lasted up to the Three Days of July, 18301655
XI.Constitution of August 9, 1830, which lasted until the Revolution of February 22, 184817197

Therefore, the total duration of these 11 constitutions is only 55 years and 55 days, and the average duration of each was therefore five years and five days!

In a work published in January with the title Alcune parole sopra diverse cause che passanno intorno a noi (Some words about things happening around us), we found the table of all the constitutions given to the various states of Europe from May 3, 1791, to August 24, 1829, therefore within a period of 38 years and three months. These amount to a number of 152, of which 12 had zero duration, that is, they were never implemented. Another 75 were already dead at the time of printing. Of the 65 surviving in 1829, none of them was older than 16 years!
