NINE DASH LINE

Deciphering the South China Sea Conundrum

Advance Praise

Chinas maritime claims in the South China Seas have become trenchant, insistent and threatening in recent years. This book goes to the heart of the issue by looking at the differences over claims as they converge on the Chinese claims based on the nine dash line. This book examines the legal arguments, the security and power implications of Chinas claims based on this line. The book also points to the economic and environmental issues related to these claims, issues that have immediacy for people in the region.

To Shobhan,

For being the wind beneath my wings

Contents

I would like to take this opportunity to extend my heartfelt gratitude to Air Marshal Vinod Patney (Retd) for showing his confidence in me and allowing me to work on this project. In fact, he had more faith in me than I had in myself when I started this book. However, that didnt stop him from providing his critical feedback on every chapter presented to him. This book is a combination of his utmost faith in me and his constant constructive criticism.

During the course of writing this book, I have benefitted immensely by constant interaction with, and feedback from, Air Marshal Kishan K Nohwar (Retd), Director General, Centre for Air Power Studies (CAPS). As my supervisor of this project, he has painstakingly gone through each and every word several times, fact-checked sources and even gave me ample food for thought for my analysis. My sincere thanks to him for bearing with my editing mistakes and enriching my work with his words of wisdom on the topic.

I cannot ever forget the gems of advice from former Air Vice Marshal Manmohan Bahadur (Retd), Additional Director General, CAPS, right from the basics such as how to make effective powerpoint presentations and coherent arguments in a logical manner. He was ever so approachable and helpful whenever I had issues to discuss with him and provided excellent inputs.

My deepest gratitude to Lieutenant General SL Narasimhan, Director General, Centre for Contemporary China Studies, and member, National Security Advisory Board, who provided me with my first brush with the Chinese military and opened my cerebral capacity towards military strategies, for his constant mentoring. I am equally indebted to Dr Madhu Bhalla for graciously lending her great expertise and insights on China that improved the quality of this project substantially.

The entire team of the Centre of Air Power Studies has been an equal contributor to this project and I have the deepest appreciation for each one of them. Dr. Manpreet Sethi and Dr. Shalini Chawla expanded my thinking horizons with their insightful questions. The officers at CAPS have added to the work with their military knowledge and I am immensely thankful to them. My colleagues at CAPS who sat through my presentations and enriched me with their knowledge of the multiple areas of their research domains only added to the depth of my understanding and made it inter-disciplinary. Without naming them all, I am thankful to each for helping me in editing and revising my chapters.

I am yet to find better and more cooperative people than Mrs. Sushma Zutshi, Ms. Surbhi Sareen, JW Lakshmi Sharma and Mr. Rohit Sharma at the CAPS library who were so hands-on with all my incessant demands for books and articles for the entire duration of writing and even after that. My sincere thanks to the publishers, KW Publishers, Ms Kalpana Shukla and her dedicated and accommodative, yet strict, editorial team for turning the manuscript into a taut book.

Several people joined what started as a solo project, happily and willingly helping out in every possible way they could. Several senior serving and retired officers from the Indian Army, Navy, Air Force and also the National Maritime Foundation have been more than gracious to review my work and provide feedback. Captain (Dr.) Gurpreet Khurana, Indian Navy, has been one most approachable and helpful persons who raised several important questions for me to ponder over. I couldnt be more grateful to each one of them and I thank all of them here. You are all as much a part of this project as I am.

A special shout-out to my friends who continue to love me despite my long absence and endless excuses due to working on this project. Dinakar Peri, Defence Correspondent, The Hindu newspaper, and, more importantly, a dear friend, has to find special mention for all his support and encouragement.

Lastly, it is my familys faith in me that is making me the person I aspired to. I draw my strength from the infinite love of my Nanu, Mom, and my siblings, Prashant and Pallavi.

This project started in November 2016 with a simple question: are events in the South China Sea (SCS) only random military contestations over landforms and maritime resources or is there any Chinese strategy towards the Nine Dash Line (NDL)? The term landforms has been used throughout the book, instead of islands, as technically most of the land bodies in the midst of the South China Sea do not satisfy the Regime of Islands criteria provided by the United Nations Convention on the Law of the Seas (UNCLOS). It has been detailed further along with its implications in the book. It was only a few months earlier after the landmark Permanent Court of Arbitration (PCA) judgment on the South China Sea on July 12, 2016 that the region was appearing once every week in the newspapers. The term found its place in Chinese statements since 2013 till the judgment was passed. However, as the days and months went by, the news on the South China Sea became everyday news but the Chinese statements shied away from using the term Nine Dash Line while referring to their ambiguously and arbitrarily placed dashes encompassing as much as 80 percent of the SCS waters.

Chinas artificial reclamation of the islands and militarisation of the waters became a concerning fact for the world. The US warships (and so also of other countries) conducted Freedom of Navigation Operations (FONOPs) soon to respond to these belligerent activities and excessive maritime claims. Rapidly, the South China Sea turned into a geo-strategic hotspot. So, why did the situation reach such a level? As it turns out, there are several areas of contestation beyond the historical territorial claims in the Nine Dash Line that are the multifaceted answers to the question raised above.
