As the worlds political and economic landscape changes in response to the rise of Asian countries such as China, so Asian influences on the global legal order will become more pronounced. Many countries in the region, such as Japan and South Korea, influence the development of international law in various ways, either individually or collectively through multinational organisations such as ASEAN. This collection of published work by leading East Asian scholars covers Asian perspectives concerning various issues in international law, ranging from general perspectives to particular themes such as international economic law, international human rights law, international ocean law, international criminal law, international security law and international dispute settlement. For the first time it provides a comprehensive picture of how and why East Asian countries participate in international law making, as well as comply with international law in their state practices. In so doing, the editors attempt to address the question whether the rising powers in East Asia will change the existing international legal order in future.

This new Library of Essays on Law in East Asia series brings together important examples of legal scholarship that has sought to analyse law and legal change in East Asia in recent times. Rapid political change and economic development of East Asian economies has sparked a growing interest in the laws and the legal systems of these countries. We have seen the passage of extensive bodies of new laws and the revision of some older laws, in many areas, especially in commercial law.
At the same time we have seen the growth in the size and complexity of legal institutions such as courts, the legal profession, law schools and regulatory bodies in East Asian countries. To some extent, East Asian law reformers have looked to Western legal models, but there has also been a strong emphasis on creating laws and legal institutions that reflect local culture and political structures. Law reform models and influences have also come from within East Asia itself and not simply from particular Western countries.
This is likely to become an increasingly important source of legal ideas in the region as the experiences of neighbouring countries are often seen as more applicable to local circumstances. Thus we have seen Japanese and Taiwanese legal models being influential in China, Chinas legal reforms inspiring interest in Vietnam, and Singapore and Malaysia being influential in South East Asia. Values drawn from Islamic and Confucian traditions have also had increasing impact on law making and legal institutions in East Asia.
