14 CFR

Parts 5, 119

  • New rule requires each Part 121 air carrier to develop and implement a safety management system (SMS) to improve the safety of its aviation-related activities.

Part 65

  • Eliminates the requirement for an air traffic control tower operator to hold a control tower operator certificate if the individual also holds a Federal Aviation Administration Credential with a tower rating (FAA Credential).

Parts 121, 135

  • Amends the maintenance regulations for domestic, flag, and supplemental operations, and for commuter and on-demand operations for aircraft type certificated with a passenger seating configuration of 10 seats or more (excluding any pilot seat), for the purpose of ensuring consistency between contract and in-house air carrier maintenance and enhance the oversight capabilities of both the air carriers and the FAA.

Part 135

  • Changes the regulations affecting helicopter operations, departing IFR/VFR when weather reporting is not available.

49 CFR

Part 175

  • Amends the requirements in the Hazardous Materials Regulations (HMR) governing the transportation of Class 7 (radioactive) materials to harmonize with international standards.
  • Modifies the requirements governing the transportation of lithium cells and batteries, including hazard communication and packaging provisions.
  • Amends the Hazardous Materials Regulations to maintain alignment with international standards, including changes to shipping names, hazard classes, packing groups, special provisions, packaging authorizations, air transport quantity limitations, and vessel stowage requirements.

An Act

To amend title 49, United States Code, to provide rights for pilots, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the Pilots Bill of Rights.

SEC. 2. FEDERAL AVIATION ADMINISTRATION ENFORCEMENT PROCEEDINGS AND ELIMINATION OF DEFERENCE.

(a) In General.Any proceeding conducted under subpart C, D, or F of part 821 of title 49, Code of Federal Regulations, relating to denial, amendment, modification, suspension, or revocation of an airman certificate, shall be conducted, to the extent practicable, in accordance with the Federal Rules of Civil Procedure and the Federal Rules of Evidence.

(b) Access to Information.

(1) In general.Except as provided under paragraph (3), the Administrator of the Federal Aviation Administration (referred to in this section as the Administrator) shall provide timely, written notification to an individual who is the subject of an investigation relating to the approval, denial, suspension, modification, or revocation of an airman certificate under chapter 447 of title 49, United States Code.

(2) Information required.The notification required under paragraph (1) shall inform the individual

(A) of the nature of the investigation;

(B) that an oral or written response to a Letter of Investigation from the Administrator is not required;

(C) that no action or adverse inference can be taken against the individual for declining to respond to a Letter of Investigation from the Administrator;
